These Terms and Conditions of Sale (the "Terms") govern all sales made through the website contact@gamin-design.com operated by Mathieu Desvignes EI, headquartered at 37 avenue de l’Hermitage, 43000 Espaly St Marcel, France, registered under SIRET number 935 351 320.
By placing an order, the Client acknowledges having read and accepted these Terms without reservation.

1. PURPOSE

These Terms define the conditions for online sales of the products offered by the Seller to the Client.
They apply, without restriction or reservation, to all orders placed through the website www.gamin-design.com.

2. ACCEPTANCE OF TERMS

By confirming their order, the Client declares their full and unconditional acceptance of these Terms, as well as any specific conditions that may apply to certain products or services.

3. PRODUCT DESCRIPTION

Products available for purchase are described as accurately as possible. However, slight variations (in color, dimensions, etc.) may occur. Product photos and descriptions are for illustrative purposes only and are not contractually binding.

4. PRICING

Prices are listed in euros (€), including all taxes (VAT) and delivery costs within mainland France.
The Seller reserves the right to modify prices at any time, but products will be billed at the rate in effect at the time the order is confirmed.

5. ORDERS

Clients may place orders on www.gamin-design.com by following the online process.
An order becomes final once payment is validated and a confirmation email is received.
The Seller reserves the right to refuse any order for legitimate reasons (e.g., product unavailable, obvious pricing error, etc.).

6. PAYMENT

Payment is made online by credit card via a secure payment system, or by any other method proposed on the website.
Orders will only be processed and shipped after full payment has been received.

7. DELIVERY

Products are delivered to the address provided by the Client at the time of order.
Delivery times are provided for informational purposes only and may vary depending on the carrier.
In case of a delay, the Seller will notify the Client as soon as possible.
Delivery costs are included in the price for mainland France and are confirmed before the order is validated.

8. RIGHT OF WITHDRAWAL

In accordance with applicable laws, the Client has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal—without having to provide a reason or pay any penalties.

To exercise this right, the Client must notify the Seller’s customer service in writing (by email or registered mail) at: contact@gamin-design.com.
Returned products must be in their original packaging, in perfect condition, and accompanied by the invoice.
Return shipping costs are at the Client's expense, unless the product is found to be defective.

9. WARRANTIES

Products are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with current legislation.
In the event of a non-compliant product, the Client must notify the Seller as soon as possible to arrange for an exchange, repair, or refund.

10. LIABILITY

The Seller shall not be held liable for damages resulting from misuse of the product or failure to follow the instructions provided.
In any case, the Seller’s liability is limited to the amount of the order in the event of a proven direct loss.

11. INTELLECTUAL PROPERTY

All elements of the website www.gamin-design.com (texts, images, logos, videos, etc.) are the exclusive property of the Seller or its partners.
Any reproduction, distribution, or modification, even partial, is strictly prohibited without prior written authorization.

12. PERSONAL DATA

Information collected during the order process is used for managing the commercial relationship and improving the services offered by the Seller.
In accordance with the French Data Protection Act and the GDPR, the Client has the right to access, correct, or delete their personal data by contacting: contact@gamin-design.com.

13. APPLICABLE LAW AND JURISDICTION

These Terms are governed by French law.
In the event of a dispute regarding the interpretation or execution of the contract, and in the absence of an amicable resolution, the French courts shall have exclusive jurisdiction.

14. AMENDMENTS TO THE TERMS

The Seller reserves the right to modify these Terms at any time.
The applicable Terms are those in force at the time the order is placed.

15. CLIENT ACCEPTANCE

By validating their order on www.gamin-design.com, the Client confirms that they have read, understood, and accepted these Terms in their entirety.
